These Terms govern your use of the NativeDSD store and website, and your purchases from us. NativeDSD Music BV ("NativeDSD", "we", "us", "our") operates this store, which is powered by Shopify. By using the store or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the store.

The short version

This summary is for readability. The full Terms below are what legally apply.

• Digital downloads can't be returned once downloaded. At checkout you confirm that delivery starts immediately and that you give up your 14-day right of withdrawal for that download. After that, all digital sales are final, except where something is genuinely wrong (see below).
• You choose the right format and resolution for your gear. You select and confirm that your DAC can play the rate you're buying. Our DAC database is a reference only, not a guarantee. If you're unsure, ask us first, and you can request DSD 256/512/1024 test files before buying.
• If a file is faulty, wrong, or won't download, contact us. We re-deliver first (this fixes almost everything). If we can't deliver a working file, you get store credit, or a refund to your original payment method if you prefer.
• Bought the same album twice by accident? Contact us. We'll swap the duplicate for another album of your choice.
• Downloads: each album includes two browser download-starts. For unlimited, stable, track-by-track downloads use the free NativeDSD Downloader app in your account. Please back up your files; we always try to allow re-downloads but can't promise availability forever.
• Need a different or extra resolution later? Available a-la-carte (price list below). NativeDSD Plus members automatically get the lower DSD rates and FLAC 96/192 where available.
• Physical items (CD, SACD, vinyl, reel): allow up to 28 days for delivery. You have 14 days to return an unwanted item; damaged, faulty, or wrong items are replaced or refunded free.
• Memberships (Lite, Plus) renew automatically. Cancel anytime before renewal in your account. Subscription fees already charged aren't refunded.
• Your files are DRM-free. They're for you and your household only. Please don't share, resell, or redistribute them.

Full Terms

1. Who we are

NativeDSD Music BV is a private limited company (besloten vennootschap) incorporated in the Netherlands, registered with the Dutch Chamber of Commerce under number [number], with its registered office at Waaldijk 76, 4171CG Herwijnen, The Netherlands. These Terms, together with our Privacy Policy and any policies referenced here, form the agreement between you and us.

2. Access and your account

To use the store you must be at least 18 years old, or the age of majority in your country if higher. You may be asked to provide information such as your email, billing, and (for physical orders) shipping details. You confirm that the information you give us is accurate, current, and complete, and you agree to keep it updated. You are responsible for the security of your account and for all activity under it, and you may not transfer or sell your account to anyone else.

3. Our products

NativeDSD sells high-resolution digital audio downloads (DSD, DXD, and other high-rate PCM and FLAC formats) and a selection of physical products (CD, SACD, vinyl, and master tape reels). The Original Recording Format is shown on each album page. We aim to represent every product accurately, but screen rendering, device settings, and the technical nature of physical media production mean appearance and specifications may vary, and specifications may change without notice. We do not guarantee that any product will be compatible with a particular device, DAC, or disc burner. Product descriptions and availability may change at any time, and we may limit quantities or restrict availability by region.

4. Formats, resolutions, DACs and downloads

This section reflects how digital audio works and is important to read before buying.

You are responsible for selecting the correct format and resolution (for example DSD .dsf, DXD .flac or .wav, or FLAC .flac) that your DAC and playback system can handle. The resolution and channel configuration you select are the only ones delivered with your order. During checkout you must confirm that your DAC can accept the selected rate.

Our DAC database is provided solely as a reference. No rights can be derived from it as to what any DAC can play. Every signal path, model, firmware, and setup differs, so please check your own equipment, and contact us before purchasing if you are unsure. You may request DSD 256, 512, or 1024 test files via our support page to verify playback before buying.

Even though we check incoming audio, a faulty file can occasionally slip through. Correcting it can take time, as the label usually has to supply replacement data, and we ask for your patience while we resolve it. As a solution to a faulty-data issue, or where you are not satisfied with the quality of a purchase, we may offer to substitute a different product or a lower resolution of the same product.

Each purchased album includes two browser download-starts. We cannot detect whether a browser download completed successfully, and we cannot guarantee downloads on mobile devices. If you have used your starts and need more, contact us. We recommend the NativeDSD Downloader app (available in your account once logged in) for stable, track-by-track downloading with no download limit.

DSD 64, 128, 256, 512, 1024 and DXD may not play on some systems or portable players even where a DAC's specifications suggest otherwise. Please test before purchasing. If you need a lower resolution after purchase because you cannot play a rate you bought, this is available a-la-carte (see section 6).

It is your responsibility to back up your downloaded files. We cannot guarantee files will remain available for download indefinitely, although we always try to provide re-downloads where possible.

5. Prices, payment and billing

When you place an order you are making an offer to purchase. Your order is accepted once we confirm it, and we must receive and process payment before acceptance. We may decline or cancel an order at our discretion, and will try to notify you using the contact details you provided.

Prices, discounts, and promotions may change without notice. The price that applies is the one in effect when you place the order, as shown in your order confirmation. Unless stated otherwise, prices exclude taxes, shipping, and customs or import charges. Advertised discounts may be used during your order but cannot be applied retroactively, except to correct a technical error. Coupon discounts do not apply to items already discounted (for example bundles).

Payment is processed by our payment service provider, Mollie, which may charge your card, PayPal, iDEAL, or other supported method. We do not store your payment details and cannot delete them for you; you can contact Mollie directly regarding payment data. By submitting an order electronically, you agree to pay for it.

6. Additional resolutions

If you want an additional resolution after buying an album, we charge a fee to create and deliver it. Request it via the link on your account page. Prices below exclude applicable taxes.

With an active NativeDSD Plus membership at the time of your music order, the DSD rates below your selected rate, plus FLAC 96 and FLAC 192, are included automatically where available for the product.

7. Memberships (Lite and Plus)

A NativeDSD membership renews automatically at the end of each subscription period. You can disable auto-renewal at any time in the subscriptions tab of your account, and cancellation takes effect at the end of the current period. Subscription fees already charged are not refunded. This does not affect your statutory rights.

Members receive member pricing on music, currently 10% for Lite and 15% for Plus. Plus members additionally receive access to the DSD rates below their selected rate, and to FLAC 96 and FLAC 192, where available for the product. Member pricing is subject to change and availability, and some labels may opt out of offering it. Other promotions are calculated consecutively at checkout.

8. Shipping and delivery (physical products)

All physical products we sell are original, official branded releases from the label and recording studio, never bootlegs, fakes, or pirated copies. Each item is supplied in its original packaging with the original studio seal where applicable, and the disc, vinyl, or reel is the original media.

Each item is either in stock or made to order. Please allow up to 28 days for delivery. In-stock items usually arrive well within this period. If we expect a significant delay beyond 28 days, we will contact you, and you may choose to wait or cancel for a full refund.

9. Returns, right of withdrawal and refunds

How this works depends on whether the product is a digital download or a physical item. An order may contain both.

9.1 Digital products (downloads). Digital products are delivered electronically and, because they can be downloaded, copied, and retained immediately, cannot be returned once delivery has begun. By completing your purchase you expressly request that delivery begins immediately, and you acknowledge that you lose your statutory right of withdrawal once the download has been made available to you. All sales of digital products are therefore final, except as follows. If the delivered file is corrupted or incomplete, you received the wrong product, or you were charged more than once, contact us and we will: first, re-deliver the correct or working file; if we cannot deliver a working file, offer you store credit for the affected purchase; or, if you prefer, refund the affected purchase to your original payment method.

9.2 Physical products. You have a statutory right of withdrawal of 14 days. You may cancel within 14 days of receiving the item without giving a reason. Notify us within that period via our support page, then return the item within a further 14 days, complete and in resaleable condition. You pay return shipping unless the item was faulty or incorrectly supplied. Once we receive the item or proof of return, we refund the purchase price plus the standard delivery cost of the original order within 14 days. Please obtain proof of postage; we cannot be responsible for items lost or damaged on their way back to us. If a physical item arrives damaged, faulty, or incorrect, contact us and we will arrange a replacement or full refund at no cost to you.

Nothing in this section affects your mandatory rights under applicable consumer law.

10. Lost or undelivered parcels

Until a parcel is delivered to you, the risk of loss or damage in transit is ours. If your order has not arrived within the expected timeframe, contact us and we will open an investigation with the carrier. Carriers require a parcel to be untraceable for a set period before it can be formally declared lost, and this period is longer for international shipments. Once that period has elapsed and the parcel cannot be located, we will, at your choice, ship a replacement or issue a full refund.

11. Import duties and customs

Prices do not include import duties, customs charges, or local taxes on deliveries outside the European Union. Where these apply they are the recipient's responsibility and are charged by your local customs authority or postal service, not by us. If you order from outside the EU, we recommend checking your local rules before purchasing.

12. Intellectual property and use of your files

The store and its contents, including text, images, graphics, audio clips, reviews, and their selection and arrangement, are owned by NativeDSD or its licensors and are protected by Dutch, EU, and international intellectual property law. You may use the store and the products you buy for personal, non-commercial use only. You may not reproduce, distribute, modify, rent, lease, lend, resell, publicly perform, or create derivative works from any product or store content without our prior written consent.

Our products are delivered without digital rights management (DRM). In return, you agree to respect the copyright in them and not to copy, sell, share, or otherwise exploit them unlawfully. Your purchases are for you and your household only. The rights in each recording remain with the phonogram producer and the registered owner of the work. NativeDSD names, logos, and branding are our trademarks and may not be used without our written permission.

13. Optional tools

We may give you access to third-party tools that we neither monitor nor control. These are provided "as is" and "as available," without warranty or endorsement, and your use of them is at your own risk and subject to the relevant third party's terms. New features or tools added in future are also covered by these Terms.

14. Third-party links

The store may link to websites or contain functionality operated by third parties. We are not responsible for the content, accuracy, or practices of those sites, and accessing them is at your own risk. Please review their terms and policies, and direct any questions about their products or services to them.

15. Automated access and agents

You may not use robots, spiders, scrapers, data-extraction tools, AI agents, or other automated means to access the store except as we expressly permit. Any agent that accesses the store must identify itself as an agent in its requests, must not conceal that it is automated or mimic human behaviour, must not complete or circumvent CAPTCHAs or other measures designed to distinguish humans from machines, must answer truthfully if asked whether it is automated, and must not bypass any measure we use to control automated access. We may limit or block automated access by technical means.

16. Feedback

If you send us ideas, suggestions, reviews, or other feedback, you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, and display it for any purpose, including commercially. You confirm you have the rights to the feedback you submit. We are not obliged to keep feedback confidential, to pay for it, or to respond, and we may remove content that we consider unlawful, infringing, or otherwise objectionable.

17. Errors, inaccuracies and omissions

Occasionally information in the store may contain errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, shipping, transit times, or availability. We may correct these and may change information or cancel orders affected by an error at any time without prior notice, including after an order is submitted.

18. Prohibited uses

You may use the store only for lawful purposes. You may not use it to break any law, infringe anyone's intellectual property, harass or harm others, transmit false or misleading information, send spam or unsolicited promotional material, impersonate anyone, upload malware, collect others' personal data, or interfere with or circumvent the store's security. We may suspend or terminate your account if you breach these Terms.

19. Relationship with Shopify

NativeDSD is powered by Shopify, which enables us to provide the store to you. Any sales and purchases you make are made directly with NativeDSD. Shopify is not responsible for any aspect of the sales between you and us, including any injury, damage, or loss resulting from purchased products, and you release Shopify and its affiliates from claims arising from your purchases and transactions with us.

20. Privacy

All personal data we collect through the store is handled in accordance with our Privacy Policy, which forms part of these Terms. Because the store is hosted by Shopify, certain data is also processed by Shopify, and may be transferred to and processed in countries other than your own in order to provide the service. Please review our Privacy Policy for details.

21. Disclaimer of warranties

Except as expressly stated by us and except for the statutory rights that you have as a consumer, the store and all products are provided "as is" and "as available" without warranties of any kind. We do not warrant that your use of the store will be uninterrupted, timely, secure, or error-free, and we may modify, suspend, or remove parts of the store at any time. Nothing in this section limits or excludes any right you have under mandatory Dutch or EU consumer law.

22. Limitation of liability

To the fullest extent permitted by law, NativeDSD and its directors, officers, employees, affiliates, agents, contractors, and licensors are not liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or replacement costs, arising from your use of the store or any product. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited, including your mandatory rights as a consumer. You remain responsible for backing up your own files and systems.

23. Indemnification

You agree to indemnify and hold harmless NativeDSD, Shopify, and our respective affiliates, officers, directors, employees, agents, and licensors from any claims, losses, liabilities, and reasonable legal costs arising from your breach of these Terms, your violation of any law or third-party right, or your use of the store, to the extent permitted by law.

24. Termination

We may suspend or terminate your access to the store, in whole or in part, if you breach these Terms or where we reasonably believe it necessary. You remain liable for amounts due up to termination. Provisions that by their nature should survive termination, including those on intellectual property, feedback, liability, indemnification, and governing law, will continue to apply.

25. General

If any provision of these Terms is found invalid or unenforceable, the rest remain in full effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the store. You may not assign your rights under these Terms without our consent; we may assign ours. We are not liable for failures caused by events beyond our reasonable control.

26. Changes to these Terms

You can always review the current version on this page. We may update these Terms by posting the revised version, and will notify you of material changes as required by law. Your continued use of the store after changes take effect means you accept them.

27. Governing law

These Terms and your use of the store are governed by the laws of the Netherlands, excluding its conflict-of-law rules. Disputes will be subject to the exclusive jurisdiction of the competent courts of the Netherlands. This does not deprive you of the protection of mandatory consumer-law provisions of your country of residence within the EU.
